HB 19-1330 Exempt Hair Drying Services from DORA Regulation:
HB 19-1330 “Exempt Hair Drying Services from DORA Regulation” which CACCS opposed, was defeated. The bill, which was introduced toward the end of the session, asked for the exemption of a person performing only hair drying services from licensure by the Department of Regulatory Affairs (DORA).
SB 19-002 Regulate Student Education Loan Services:
SB 19-002 “Regulate Student Education Loan Services” passed at the end of the legislative session. The bill requires student loan servicers to obtain a license and establishes an ombudsperson. The ombudsperson will be in higher education, review complaints and ensure that loan servicers are licensed under the Uniform Commercial Code (UCC), which is under the AG’s office.

SB 18-177 Private School and Private Occupational School Bonds:
SB 18-177 “Private School and Private Occupational School Bonds,” which was supported by CACCS was signed by Governor. Under current law, private occupational schools and certain private, degree-granting schools are required to provide a bond or other form of surety in order to facilitate transfer for or provide tuition reimbursement to students, should the school close. In addition, when a private occupational school closes, the school’s records are maintained by the Department of Higher Education (DHE). The bill allows the DHE to make a claim on the surety bond for administrative costs associated with the school closure, and retain an amount of the surety, after reimbursing tuition or facilitating a transfer, that is no greater than the cost of administrative expenses.
SB 18-193 Limit State Agency Occupation Regulations:
SB 18-193 “Limit State Agency Occupation Regulations,” which was opposed by CACCS was postponed indefinitely. The bill prohibits state agencies from imposing a personal qualification requirement in order to engage in a professional or occupation unless the agency can show that the requirement is demonstrably necessary and narrowly tailored to address a specific, legitimate public healthier, safety, or welfare objective.
SB 18-260 Sunrise Review New Private Occupation Schools:
SB 18-260 “Sunrise Review New Private Occupation Schools,” which was opposed by CACCS was postponed indefinitely. The bill required the private occupational school board (board), with the assistance of the private occupational school division within the department of high education (division), to promulgate rules creating a sunrise review process. The sunrise review process applies to new educational credentials and new educational services, as defined in the fill, for this the board has not previously granted or denied a certificate of approval prior to a date set forth in the bill. The purpose of the sunrise review is to determine whether the new educational credentials or new educational services hold be regulated by the board and vision pursuant to the provisions of the “Private Occupational Education Act of 1981’ (Act). Until the sunrise review process is completed, the board and division shall not exercise the powers and duties under the Act with respect to the new educational credential or new educational service.
